When You Can, and Can’t, Use Our Name and Trademark
Quick Overview
We want to prompt the use of DoView® Planning and DoViews® Therefore, we want anyone to be able to use these names and logo in their work even thought the DoView Logo and name are our trademarks. In summary,
You’re free to use the DoView® Planning approach and draw DoViews in your own work (including paid consulting, training, and software) as long as you follow this Policy.
Always call the approach DoView® Planning and the diagrams DoViews / DoView® diagrams, and include an attribution line naming Dr Paul Duignan and DoViewPlanning.org.
You may build features of the legacy DoView® app into your own apps or platforms with attribution and a clear “not affiliated with or endorsed by DoView®” notice.
You must not claim to be certified, official, or endorsed by DoView®, or use the DoView® Marks in your own company/product names, logos, or domains.
Please don’t copy or republish the DoViewPlanning.org website or the full DoView® Planning and Outcomes Theory Handbook; use reasonable extracts only and direct people to the site (or our book listing) for the full materials.
When you can and can’t use the DoView® trademark and material
DoView® Planning Attribution & Trademark Use Policy
Definitions
“DoView® Marks” means DoView®, DoView® Planning, and the DoView® logo.
“DoViews” means DoView® outcomes/strategy diagrams (also referred to as DoView® diagrams).
“Materials” means text, diagrams, images, and other content from DoViewPlanning.org and the DoView® Planning and Practical Outcomes Theory Handbook and other work by Dr Paul Duignan related to DoView® Planning or outcomes theory.
“Legacy App Features” means features of the DoView® legacy app at DoViewPlanning.org/app.
We want people to freely use the DoView® Planning approach and DoViews, including in consulting, training, and software, as long as you follow this Policy and applicable law and do not use the DoView® Marks or Materials in ways that are illegal, harmful, or misleading.
1) Permitted reference use (non-exclusive, revocable)
You are welcome to use and refer to the DoView® Planning approach and DoViews, but you must follow this Policy and not suggest we endorse you or your products unless we have agreed in writing.
You may do this in both free and commercial work; no separate licence or fee is required if you comply with this Policy.
All permissions under this Policy are conditional on your use being lawful and not falling within the “Prohibited uses” listed in section 7.
2) Required attribution (name + website)
If you use the DoView® Planning/outcomes theory approach or draw diagrams based on it, you must:
Clearly say you are using the DoView® Planning approach; and
Call the diagrams DoViews or DoView® diagrams; and
Include a nearby attribution such as:
“This work uses the DoView® Planning approach and DoView® diagrams (DoViews) and DoView® is a registered trademark of DoView Corporation Limited. See DoViewPlanning.org.”
Include this in a slide footer, footnote, report acknowledgements, website page, or an app “About/Help” screen—wherever is reasonable.
Attribution should include both “Dr Paul Duignan” and “DoViewPlanning.org.”
3) Using/implementing Legacy App Features in your software
We encourage you to implement features of the DoView® legacy app in your apps, platforms, or other systems (including commercial products). No separate licence or fee from us is required if you:
Acknowledge in your product, for example:
“Includes features based on the DoView® Planning approach and DoViews – see DoViewPlanning.org.”
Call the diagrams your product produces DoViews (or DoView® diagrams) when they are based on the DoView® Planning approach; and
Add a no-endorsement notice, for example:
“Not affiliated with or endorsed by DoView®.”
You may not use the DoView® logo in your own product logo or brand identity (see section 7).
4) Teaching & consulting
You are free to teach or consult using the DoView® Planning approach, and you may charge for that work. Please:
Describe this as teaching or consulting on:
the DoView® Planning approach; or
drawing DoViews / DoView® diagrams; or
outcomes theory using the DoView® Planning approach; and
Direct learners and clients to DoViewPlanning.org.
Unless we have agreed in writing, you must not present yourself as officially endorsed or certified by DoView® (see section 5).
5) No endorsement/qualification claims
Unless we give you written permission, please do not say or imply that you are:
“DoView® Certified”
A “DoView® Partner”
A “DoView® Certified Consultant/Trainer”
Providing “Official DoView®” training or consulting
That your diagrams, tools, or products are “DoView® Certified”
Or anything similar that suggests official endorsement, certification, or partnership.
Only we can state that something is “officially endorsed by DoView®” or similar.
6) Re-use of website and DoView® Handbook content
You may quote or use reasonable extracts from DoViewPlanning.org and the DoView® Planning and Practical Outcomes Theory Handbook in training or consulting, with:
Clear attribution to Dr Paul Duignan and DoViewPlanning.org, and
A link to DoViewPlanning.org where practical.
We encourage you to link people to any of the DoView® Tools in the DoView® Handbook on this website.
However, you must not:
Substantially reproduce the DoViewPlanning.org website on another website. This includes copying large sections of pages, recreating most of the site’s content, or publishing collections of DoViews from the site as a separate “DoView® library.”
Upload the entire DoView® Handbook, or substantially all of it, to any website, learning management system, shared drive, intranet, or other system.
Print and distribute, or otherwise provide, full printed or electronic copies of the DoView® Handbook yourself.
Instead, please direct people to DoViewPlanning.org (and to our Amazon listing once available) to access or purchase the full book.
If you want broader or different use, contact us—we’re keen to facilitate dissemination of the DoView® Planning and outcomes theory approach.
7) Trademark and logo rules
To protect the value and clarity of the DoView® Marks:
Use of word marks
Use DoView® and DoView® Planning as brand names, not generic terms.
Use the ® symbol on first prominent use on a page or document.
Use of the DoView® logo on DoViews
You may display the DoView® logo on DoViews you create to indicate they use the DoView® Planning approach, provided that:
The logo is used in a reasonable, non-dominant way on the diagram;
You include the required attribution and trademark notice (sections 2 and 8);
You do not suggest that the diagram is “endorsed”, “certified”, or “official DoView®” unless we have agreed in writing; and
You do not use the logo on DoViews whose content falls within the “Prohibited uses of the DoView® Marks” listed below.
Use of the DoView® logo or word marks on a diagram simply indicates that the diagram uses the DoView® Planning approach. It must not be presented in a way that implies we agree with, approve, or participate in the specific content of the diagram.
Prohibited uses of the DoView® Marks
You must not use the DoView® Marks:
In connection with illegal activity, or content that promotes, facilitates, or glorifies criminal activity;
In connection with hateful, harassing, or discriminatory content directed at individuals or groups based on characteristics such as race, ethnicity, religion, disability, gender, sexual orientation, or similar;
In connection with misleading, fraudulent, deceptive, or scam content;
In any way that is defamatory, obscene, or otherwise likely to damage the reputation of DoViewPlanning.org, Dr Paul Duignan, or DoView Corporation Limited; or
In a way that could reasonably cause people to believe that we endorse, are affiliated with, or are responsible for illegal, harmful, or deceptive content.
Restrictions on logo and name use in identities and domains
Please do not use the DoView® Marks in your company name, product name, logo, or domain name.
Please do not alter the DoView® logo.
If you want to discuss a special use (e.g. co-branding, official program), contact us.
8) Trademark notice, reservation of rights & termination
Please include this notice where appropriate (e.g. in the footer of materials that refer to DoView®):
“DoView® is a registered trademark of Dr Paul Duignan.”
We may update this Policy if necessary and may revoke permission for any use of the DoView® Marks or Materials at any time, particularly where use does not comply with this Policy or applicable law, or where we reasonably consider that the use risks harming our reputation, confusing users, or diluting the distinctiveness of the DoView® Marks. All rights not expressly granted are reserved.
